Terms of Service

1. Acceptance of Terms​

By accessing and using our platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Platform Description​

The Platform provides a digital canvas where users can create collaborative artwork using our native RGB tokens and/or ETH. The resulting artwork may be converted into Non-Fungible Tokens ("NFTs") and sold on our marketplace.

3. User Requirements​

3.1. You must have a valid cryptocurrency wallet capable of handling RGB tokens and ETH to participate.

3.2. You must be of legal age in your jurisdiction to enter into binding contracts.

3.3. You are responsible for maintaining the security of your wallet and credentials.

4. Drawing Rights and Costs​

4.1. Drawing on the canvas requires payment in RGB tokens and/or ETH.

4.2. Transaction fees ("taxes") apply to all drawing actions.

4.3. We reserve the right to modify transaction fees at any time without prior notice based on platform demand and traffic.

4.4. All fees are non-refundable once a transaction is confirmed on the blockchain.

4.5. Blockchain transaction fees (gas fees) are separate from and additional to Platform fees and taxes.

5. NFT Creation and Revenue Distribution​

5.1. Upon canvas completion, we create timelapse NFTs of the collaborative artwork.

5.2. Revenue from NFT sales will be distributed proportionally among contributing artists based on the number of pixels drawn.

5.3. Distribution of proceeds occurs within 30 days of the NFT sale completion.

5.4. Users acknowledge that their drawings may be included in NFTs and grant us the right to use their contributions in this manner.

5.5. NFT sale prices may vary based on market conditions and demand, and we make no guarantees regarding the value or marketability of NFTs.

6. Lottery​

6.1. Certain canvases may include an optional lottery feature.

6.2. Entry into the lottery requires RGB/ETH tokens.

6.3. Winners are randomly selected when the canvas is completed.

6.4. The distribution percentages of the lottery pool is determined at our discretion.

6.5. Participation in the lottery is entirely optional and separate from the main canvas feature.

6.6. Participation in the lottery pool does not guarantee winning. Winners are selected randomly and the odds of winning depend on the total number of participants and the distribution percentages.

7. Content Moderation​

7.1. We reserve the right to moderate all content drawn on the canvas.

7.2. We may remove any drawings that violate our content guidelines, including but not limited to:

  • Explicit or adult content
  • Hate speech or discriminatory content
  • Copyrighted material
  • Illegal content
  • Spam or malicious content

7.3. We reserve the right to ban accounts from participating in future canvases for violations of these Terms.

7.4. Moderation decisions are final and at our sole discretion.

8. Prohibited Activities​

Users agree not to:

8.1. Use automated scripts or bots to draw on the canvas

8.2. Attempt to manipulate or exploit the lottery system

8.3. Create multiple accounts to circumvent bans or restrictions

8.4. Interfere with other users' ability to participate

8.5. Attempt to reverse engineer or compromise the Platform

9. Intellectual Property​

9.1. Users retain ownership of their individual drawings.

9.2. By participating, users grant us a worldwide, royalty-free license to use their drawings in NFTs and promotional materials.

9.3. Users warrant that their drawings do not infringe on any third-party intellectual property rights.

10. Disclaimers and Limitations of Liability​

10.1. The Platform is provided "as is" without warranties of any kind.

10.2. We are not responsible for:

  • Cryptocurrency price fluctuations
  • Network congestion or transaction delays
  • Lost or stolen cryptocurrencies
  • Technical failures outside our control

10.3. Our liability is limited to the amount paid by you for using the Platform in the 30 days preceding the claim.

11. Changes to Terms​

11.1. We reserve the right to modify these Terms at any time.

11.2. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11.3. Users will be notified of material changes to these Terms.

12. Termination​

12.1. We reserve the right to terminate or suspend access to the Platform at any time.

12.2. Users may terminate their participation at any time by ceasing use of the Platform.

13. Governing Law​

These Terms are governed by Australian law, without regard to conflict of law principles.
